Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING SWEEPSTAKES IS VALID IN THE 50 UNITED STATES (U.S.) AND DISTRICT OF COLUMBIA (D.C.) ONLY, AND IS OPEN ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE RULES BELOW). VOID ELSEWHERE AND WHEREVER PROHIBITED. DO NOT PARTICIPATE IN THE SWEEPSTAKES IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.
Sweepstakes Name: Sunkist Little League Baseball World Series Sweepstakes (the "Sweepstakes").
Sweepstakes Dates: Sweepstakes registration is scheduled to begin on March 1, 2008 and end on July 12, 2008 (the "Registration Period"). The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void outside the U.S. and where prohibited.
Who may Enter: Sweepstakes is open to legal residents of the 50 United States and D.C. only, who are age 13 or older as of date of entry, except the following persons who are not eligible to enter or win:
- Employees, officers, and directors of Sunkist, Sunkist Growers Inc. ("Sponsor"), Contest Administrators, each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this promotion (collectively, "Released Parties"), and the members of the immediate families or households, whether or not related, of any of the above. "Immediate family members" includes, for purposes of this promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children (including step grand children) and each of their respective spouses, regardless of where they reside.
- Persons who are unwilling or unable to travel to Williamsport, PA to attend the 2008 Little League Baseball World Series game scheduled to be played on Sunday August 24, 2008.
- Persons who are unwilling or unable to participate in the on-field baseball skill related grand prize contest (as described below) prior to or during the 2008 Little League Baseball World Series game scheduled to be played in Williamsport, PA on Sunday August 24, 2008.
- Persons who have played baseball at any professional or semi-professional level, or who have played at the High School or Collegiate level within the last 5-years, or any individual who is a current coach of an organized baseball league at the equivalent of the Little League level or higher.
How to Enter:
NO PURCHASE NECESSARY. To enter via on-line entry, visit www.Sunkist.com during the "Registration Period" and click the Sweepstakes entry button to connect to the Sweepstakes registration page. Each entrant must fully complete the registration page with all required information including his/her name, complete address, valid email address, birth date, and phone number(s) (including area code(s)). Any entrants between the ages of 13 - 17 years of age must have their parent or legal guardian's permission in order to submit an eligible entry. After having read and agreed to these Official Rules, click the submit button to submit your on-line entry. All on-line entries must be fully complete for all required information. Maximum of one on-line entry per person and per valid email address. Any on-line entry submitted with an invalid email address will be disqualified.
Incomplete or illegible entries will be disqualified. Released Parties are not responsible for lost, late, misdirected, illegible, incomplete, invalid, unintelligible, damaged, or postage due mail or entries, or for entries submitted in a manner that is not expressly allowed under these rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer transmissions and/or network connections; all of which will be disqualified.
Each participant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual or using another person's email address or name will be disqualified and ineligible to claim the prize. Any attempt by any participant to obtain more than the stated number of entries allowed by using same, multiple/different email addresses, identities, or any other methods void that participant's entries and that participant may be disqualified. No mechanically reproduced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void.
In the event of a dispute as to any on-line registration, the authorized account holder of the e-mail address used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. All entries received become the property of the Sponsor and will not be returned.
Finalist Selection & Notification: On or about July 14, 2008, a random drawing will be held from among all eligible entries received to select a total of one (1) potential finalist who will receive a trip to the designated "2008 Little League Baseball World Series Game" in Williamsport, PA and the opportunity to participate in the On-Field Baseball Skill Contest (see descriptions below). Odds of being selected as the finalist are dependent upon the total number of eligible entries received. Decisions of the Administrator in the selection and determination of finalist and, all matters relating to this Sweepstakes are final and binding.
The potential finalist will be notified initially by phone beginning on or about July 18, 2008. If the Administrator is unsuccessful in its attempts to reach and speak directly with potential finalist by phone after three attempts over a 48-hour period to the phone number listed on that finalist's entry, then that finalist will be disqualified and, at Sponsor's discretion, an alternate finalist will be randomly selected from among the remaining eligible entries and notified as per the procedures outlined above (time permitting). During the finalist notification phone call, the potential finalist must confirm his/her eligibility, and indicate his/her willingness to accept the prize, and confirm his/her ability to be present for the On-Field Baseball Skill Contest (see below) during the designated 2008 Little League Baseball World Series game in Williamsport, PA on Sunday August 24, 2008. The finalist will then receive official notification via certified or overnight mail delivery.
If the selected finalist does not meet the eligibility requirements, is unable or unwilling to attend or participate in the On-Field Contest event, or elects to decline the finalist prize, s/he will be disqualified and, at Sponsor's discretion and time permitting, an alternate finalist will be randomly selected from among all remaining eligible entries and notified as per the procedures outlined above. Any disqualified finalist will not receive any alternate prize substitution or compensation.
All of the following will apply for the finalist : 1) Finalist will be required to complete and return, within 5 days of date of receipt, a prize acceptance form, a W-9 form, an affidavit of eligibility, and a liability/publicity release (where permitted); 2) The finalist will be required to present a copy of a valid social security card and a valid driver's license as a condition of participating or receiving the prize; 3) The finalist will be issued an IRS Form 1099 reflecting the actual value of the prize won; and 4) The finalist will be responsible for paying all applicable taxes (including, but not limited to all local, state and federal taxes) on the prize awarded. Failure to collect or properly claim the prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, finalist will not receive any other prize substitution or compensation, and the prize will remain the property of Sponsor and will not be awarded, except as provided herein.
If the finalist is under the age of 18, or at least 18 years of age but still considered a minor in his/her jurisdiction of residence, Sponsor may, at its sole discretion, award the prize in the name of his/her parent or legal guardian who must accept the prize on behalf of the finalist, and who will be responsible for completing all required winner documents and fulfilling all requirements imposed on finalist/winner set forth herein. However, any eligible minor winner must participate in the On-Field Baseball Skill Contest on his/her own behalf and be accompanied by his/her parent or legal guardian as one of their designated travel guests.
On-Field Baseball Skill Contest Event: During the grand prize event date, the finalist will be brought onto the field to attempt a "Baseball Target Pitch Contest". The Target Pitch contest will consist of the finalist attempting to throw (3) strikes through the target opening of a designated Target Board. The exact dimensions of the Target Hole and the distance of each Target Pitch will be disclosed to the grand prize finalist immediately prior to their contest attempt.
The following requirements will apply to the finalist's Target Pitch attempt:
- The finalist must attempt the contest on his/her own behalf. Participation in the grand prize contest is non-transferable.
- All attempts must occur in the presence of the sponsor designated Contest Administrator, and will be captured on video tape.
- Selected finalist will not be allowed any practice or warm-up attempts prior to their grand prize contest attempt.
- The finalist will have a maximum of (3) baseball toss attempt at the designated target.
- In order to be eligible to claim the grand prize, the finalist must successfully pitch all (3) of his/her Target Pitch attempts completely through the designated Target Hole opening on the target board. If the finalist misses any of their (3) target pitch attempts, he/she will not be eligible to claim the grand prize.
- The exact distance and dimensions of the finalist's target toss will be disclosed at the grand prize event immediately prior to the attempt.
If the eligible finalist successfully completes all (3) baseball target pitch attempts by pitching all 3 baseballs through the target hole as required by these Official Rules, that finalist will be eligible to claim the grand prize (see grand prize descriptions below). If the finalist does not successfully complete all (3) baseball target pitch attempts as required by these official rules, then the grand prize will not be awarded.
If the eligible finalist successfully pitches either 1 or 2 of their target pitch attempts through the target hole, he/she will be eligible to claim a bonus prize (see bonus prize descriptions below). If the finalist does not successfully complete either (1) or (2) baseball target pitch attempts as required by these official rules, then the corresponding bonus prize will not be awarded.
Prize:
Finalist Prize - 2008 Little League Baseball World Series Trip: The finalist will receive a trip for four (4) (finalist and three (3) guests) to a designated 2008 Little League Baseball World Series game in Williamsport, PA. The trip to the Little League Baseball World Series game includes:
- Round trip coach class airfare for four (4) departing from the major airport nearest winner's home, as designated by Sponsor (finalist is responsible for transportation to and from designated airport);
- Three (3)-nights' standard hotel accommodations, quad occupancy at hotel designated by Sponsor arriving August 22, 2008 and departing August 25, 2008.
- Four (4) tickets to each of the designated 2008 Little League Baseball World Series games on Saturday August 23, 2008 (2 games) and the championship game on Sunday August 24, 2008.
- $1,000 spending money for meals, ground transportation etc.
Actual trip dates will be specified by Sponsor at time of winner notification, and are subject to change solely at Sponsor's discretion. Departure dates and times are subject to availability and at the sole discretion of the Sponsor. Certain restrictions and black out dates may apply. Winner and his/her guests must travel together on the same itinerary. Any changes to completed travel arrangements, once booked, are the sole responsibility of the winner, and are solely at the winner's expense.
If the finalist's travel guest is under the age of 18, or not considered to be of legal age of majority in his/her state of residence, then the travel guest's legal parent or guardian must also accompany the traveler as one of the additional guests or at their own expense. All travel guests may be required to execute and return a liability/publicity release prior to prize award (or have a legal parent or guardian complete such documents on their behalf). Tickets are subject to certain terms and conditions specified thereon. Seat locations will be determined by Sponsor. Finalist and guest(s) must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of prize. All meals, service charges, gratuities, applicable taxes (including, but not limited to all local, state and federal taxes) and any other expenses not specified herein as being included in the finalist prize are the sole responsibility of the finalist. Approximate retail value ("ARV")
of the grand prize trip: $6000.00. Actual value will depend on point of departure and any airfare fluctuations.
Released Parties are not responsible for any travel difficulties or delays that prevent the finalist from participating in the On-Field Baseball Skill Contest or attendance of the game. If travel delays or difficulty prevent arrival in time for any and all elements of trip, Sponsor is not responsible for awarding any compensation or substitution in lieu thereof.
Grand Prize - 3 of 3 Successful Baseball Target Pitch Attempts: If the finalist successfully pitches all (3) of his/her (3) baseball target pitch attempts through the target hole in the designated target board, he/she will be eligible to claim the grand prize: $1,000,000, payable as a 40-year annuity in the amount of 40-equal, annual installments of $25,000 Cash, without interest on or about the anniversary date of such successful completion of the grand prize contest requirements.
Bonus Prize - 2 of 3 Successful Baseball Target Pitch Attempts: If the finalist successfully pitches (2) of his/her (3) baseball target pitch attempts through the target hole in the designated target board, he/she will be eligible to claim the 2 of 3 bonus prize: $10,000 Cash, payable as a check to the finalist within approximately 2-weeks of such successful completion of the contest attempt.
Bonus Prize - 1 of 3 Successful Baseball Target Pitch Attempts: If the finalist successfully pitches (1) of his/her (3) baseball target pitch attempts through the target hole in the designated target board, he/she will be eligible to claim the 1 of 3 bonus prize: $1,000 Cash, payable as a check to the finalist within approximately 2-weeks of such successful completion of the contest attempt.
All prize awards, if any, are non-cumulative, and subject to verification of compliance with these Official Rules and approval. All federal, state and local taxes are winner's sole responsibility. The prize award is non-transferable and no cash redemption or prize substitution allowed, except at Sponsor's sole discretion or as provided herein. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion. Maximum ARV of the prize: $413,500 based upon the approximate present cash value of the $1,000,000 40-year annuity.
Additional Rules & Restrictions: By participating in this Sweepstakes, entrants (and, if eligible minors, their parents or legal guardians) agree to abide by and be bound by the Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Sweepstakes. In the event an entrant wins the prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in Sweepstakes constitutes permission for the Sponsor and its designees to use entrants' names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts
shall render entrants ineligible for the prize.
By participating, entrants (and, if eligible minors, their parents or legal guardians) agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to an entrant's participation in this Sweepstakes, or the acceptance, possession or use/misuse of the prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor.
Released Parties shall not be liable to winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause.
Participants are restricted to use of ordinary and typical computer equipment and Internet access. Sponsor disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor's control, or otherwise. The Sponsor disclaims any liability for received entries due to technical difficulties or transmission errors. The Sponsor disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which
may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitations, errors which may occur in connection with the printing or advertising of this Sweepstakes, administration or execution of the Sweepstakes, the conducting of the On-Field Baseball Skill Contest, the cancellation of the game, the processing of entries or in the announcement of the prize or prize winner.
Sponsor reserves the right to cancel, modify or terminate the Sweepstakes if fraud, misconduct or technical failures destroy or threaten the integrity of this portion of the Promotion, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Sponsor reserves the right to determine the finalist in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination.
IN CASE OF DISPUTES: By participating, each entrant (and, if an eligible minor, his/her parent or legal guardian) agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within Los Angeles County, in the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, and in no event will entrant be entitled to received attorneys' fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
