Sunkist Sexy Citrus Drinks™ Contest
Official Rules
NO PURCHASE NECESSARY. THE FOLLOWING CONTEST IS INTENDED FOR THE PRE-SELECTED ESTABLISHMENTS CHOSEN BY SUNKIST FOR THIS CONTEST AND BARTENDERS OF CHOSEN ESTABLISHMENT WHO ARE 21 YEARS OF AGE OR OLDER. THE FOLLOWING CONTEST IS INTENDED FOR RESIDENTS OF THE 50 UNITED STATES, INCLUDING THE DISTRICT OF COLUMBIA, ONLY. VOID WHERE PROHIBITED BY LAW.
- TO ENTER: You may enter by email or mail. Option 1: Submit your drink recipe via email to Courtney.Carlisle@mslpr.com. You may submit one (1) citrus drink recipe via email. Enter the required information from the official entry form and follow the instructions on how to complete your submission. All online entries must be submitted between 12:01 A.M. (CST) on 01/19/05 and 11:59 P.M. (CST) on 02/14/05. Option 2: You can submit one (1) recipe by mail, completing the official entry form or hand writing on a 3" X 5" card, your full name, address, city, state/province, zip/postal code, daytime and evening phone number, age, email address (optional) and your recipe. Mail entry, in an envelope bearing sufficient postage, to: Sunkist Sexy Citrus Drinks™ Contest, 6500 Wilshire Blvd. Suite 1900, Los Angeles, CA 90048 (USA). All mail-in entries must be postmarked by 02/14/05 and received by 02/28/05. Limit one entry per person/establishment regardless of entry method. Only eligible entries actually received by Sunkist before the end of the specified entry period will be included in the contest. All entries become the property of Sunkist and will not be acknowledged or returned. If required information is not completely filled out, your entry will be disqualified.
- JUDGING: Members of Sunkist's agencies will judge entries on the following criteria: (1) Taste of beverage (50%); (2) Link to Sunkist brand character (fun, energetic, upbeat) (25%); and (3) Recipe logistics (instruction clarity, ease of making beverage, readily available ingredients) (25%). In the event of a tie, the winner will be determined by Sunkist on the basis of score for the first criteria, continuing thereafter to each additional criteria in numerical order as needed to break the tie. The top three (3) drink recipes in each of the three (3) featured markets will be posted on the Sunkist Web site and finalists will be voted on by consumers via the Sunkist Web site in order to determine a final winner.
- PRIZE DETAILS: One (1) Grand Prize: Winning recipe bartender will receive a $2,500 check and winning bartender's establishment will receive: a $2,500 check, a two (2) month supply of Sunkist citrus (Approximate retail value $1,000) and one (1) Sunkist juicer (ARV $550). Total ARV of all Grand prizes: $6,550. (2) Runner-up Prizes: The second and third place bartenders will receive a $1,000 check and second and third place bartender's establishment will receive: a $1,000 check, a two (2) month supply of Sunkist citrus (Approximate retail value $1,000) and one (1) Sunkist juicer (ARV $550). Total ARV of all second and third place prizes: $2,550. In the case of unavailability of a prize, Sunkist, in its sole discretion reserves the right to substitute prize with similar prize of equal or greater value. Prizes are not transferable. Federal, state, provincial and local taxes, if any, are the sole responsibility of the winner. No substitutions or cash redemptions allowed by winner. Except as specifically provided herein, prize does not include any other items not specifically described in these Official Rules.
- ENTRY DETAILS: Entries must be of entrant's own fully original creation, may not have been used in another competition, and must not be subject to or violate any rights of any other parties. Entries may not be offensive or defamatory, as determined by the judging panel in its sole discretion. Entries not complying with official contest requirements will be subject to disqualification. Sunkist shall have the right to publish, distribute, assign or otherwise use any and all submitted recipes, in any and all media now known or hereafter developed, without the approval of entrants. By submitting entry, entrant warrants that drink recipe is original and that entrant or entrant's establishment is the sole copyright owner, and that entry is not based upon or derived from a copyrighted work. By entering this contest, each entrant/establishment grants Sunkist the right to reproduce, publish, post recipe on Web site or exhibit the recipe, in whole or in part, without charge or compensation. Sunkist reserves the right to post random entries on the Web site during the promotion, in its sole discretion.
- AWARDING OF PRIZE: On or about 12:00 P.M. (CST) on 03/01/05, at Sunkist's sole discretion, members of Sunkist's agencies will judge which recipe from 1 popular bar in 5-9 randomly featured cities, will be finalists, from among all the qualified entries received. Decisions of the judging panel are final on all matters relating to compliance with the contest rules, eligibility, and selection of finalists, and are not subject to challenge. Once finalists have been chosen, finalists will be required to sign and return a release granting Sunkist permission to post the recipes. Sunkist will then post recipes on www.sunkist.com for consumers to vote from 03/16/2005 to 04/15/2005. At 12:00 A.M. (CST) on 04/16/2005 voting will cease and votes will be tallied. One (1) winner will be announced on 04/22/05. Winner will be notified on or about 4/22/05 by a member of Sunkist's agencies. If a selected winner entered the contest online, the prize will be awarded to the authorized account holder of the submitted Internet e-mail address, if selected, regardless of the individual who submitted the entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet Service Provider or other organization that is responsible for assigning e-mail addresses or the domain names associated e-mail addresses. Potential winner will be required to complete and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of date notice sent or prize will be forfeited and may be awarded to an alternate winner. If any prize or prize notification is returned as undeliverable, prize will be forfeited and an alternate winner will be selected. By accepting a prize, winner and winner's establishment consents to use their name, photograph, likeness, biographical information and address (street address, city and state/province only) and submitted recipe entry in any form for advertising or publicity purposes without further compensation, payment or credit, except where prohibited by law. All prizes to be awarded by 08/01/2005. Limit one (1) prize per person.
- ELIGIBILITY: Contest open to the pre-selected establishments chosen by Sunkist for this contest and bartenders of chosen establishment who are legal U.S. residents, 21 years of age or older. Employees, and those living with employees of Sunkist Growers, Inc., and their affiliate companies, subsidiaries, advertising and promotion agencies (collectively, "Sunkist Affiliates"), and their family members are not eligible to enter or win.
- GENERAL CONDITIONS: It is your responsibility to ensure that you have complied with all of the conditions contained in the Official Rules. Sunkist and Sunkist Affiliates are not responsible for late, lost, destroyed, technically corrupted, incomplete, postage due or wrongly addressed mail in connection with this contest. Sunkist and Sunkist Affiliates are not responsible for any lost, late, incorrect or inaccurate information, downloading of entries or Internet transmissions for any reason, or for any computer, phone, phone line hardware or software malfunction, failure or error in any kind, whether mechanical, human or electronic, or incomplete or unusable uploads. Sunkist and Sunkist Affiliates are not responsible for any injuries, damages or losses which may be sustained in connection with this contest and/or the ownership, use or misuse of the prize. If, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sunkist which corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, Sunkist reserves the right to its sole discretion to cancel, terminate, modify or suspend the contest, or the online portion of the contest, and select winner among all eligible entries received prior to the cancellation. Persons found tampering with or abusing any aspect of this contest, or whom Sunkist believes to be causing malfunction, error, disruption or damage will be disqualified. Sunkist reserves the right to correct any typographical, printing, computer programming or operator errors. As a condition of entering this contest, participant agrees that: (1) under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (2) any and all disputes, claims and causes of action arising out of or connected with this contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively arbitration; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorney's fees; and (4) participant shall be bound by these Official Rules. By entering, all participants agree to release Sunkist and its subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies, and related entities from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this contest, or the acceptance, possession, use or misuse of prize and claims based on publicity rights, defamation or invasion of privacy, copyright infringement, trademark infringement or any other intellectual property right and merchandise delivery.
